Many lawyers nearly never try a DWI case. I try a lot of cases. My goal is to have you found not guilty of all charges. I temper that goal with an understanding of the sentencing consequences in DWI cases. I never want to plead not guilty and have my client punished more harshly because of a such a plea and I am often able to avoid additional punishment by being careful about where, when, and how we argue your case.

District Attorneys have a lot of responsibility in DWI cases and are often not well prepared to perform all of the duties required of them because they are accustomed to guilty pleas being entered at an early stage. I can’t promise that you will be found not guilty because each case is different. I can promise that I will leave no stone unturned in my quest to minimize the consequences to you in every way.

In every DWI case in NC the district attorney has to prove:

  • You were driving on a street, a highway or a public vehicular area.
  • That you were actually impaired or that you tested .08 or greater on the breath test at the station or on a blood test.
  • The officer had the right to stop you or had the right to question you.
  • The officer had probable cause to arrest you.
  • All the procedures were followed in regards to your arrest and in regards to breath or blood testing.
  • You were properly informed of your rights at the appropriate times in the process and you were not prevented from exercising those rights by the state’s agents.
  • You were treated fairly during the process.
